Obligated? Nope. In the past they would, but they had problems with people buying the game, ripping it onto CD and then returning it. So, EB/Gamestop ...stopped doing that. Basically all sales are final and if you don't like the game TS. The only way they'll take it back is if it doesn't work, but then all you get is a replacement copy. Otherwise you are looking at store credit for a trade in.
Aren't stores are obligated to take software back if you say you don't accept the license? That's all that it is really... a part of the license. [/b]
